wow..serious BS man.....those are the type of cops that give all of them a bad name.


but by looking at the pics....just what did you guys destroy? i see nothing but mud, dirt, a little pond and a bunch of weeds.

i wonder if the owner really did change his mind? that cops sounds to have a personal grudge against that one guy.....wonder if he can prove it as harassment?

seems like we have greater enemies that are our own people

Damn dude that sucks, what did you guys "distroy" it fight that shit all the way, if they have no proof of you destroying anything thats total bs man.

sounds like the cop is harassing him, especially because at first the dude said not to press charges, but then after the charger cop came by he did.

you might be able to get that property owner to side with you.

but dude htat sucks, and is the reason most ppl hate cops.
 
Him calling you to come in and charges will be dropped.....you did that and were arrested. That is called entrapment. Make sure you mention that to your lawyer. That's is a major violation of your rights!

ah damn thats the word I was looking for! Entrapment! I was trying to think of what the hell it was called. Thats a BIG issue... that prick probably uses it a lot too from the sounds of it.
 
So like mentioned, did the property owner ever go to loook at his own property to see what was "destroyed"? I wouldn't think he could just press charges based on the cop saying you did all that shit. The property owner has to prove that you destroyed everything that was claimed. Also, I'd use the pictures you did take and any more as evidence that you were only there to pull the jeep out and weren't part of the "destruction" and didn't know at the time that you were on private property.

but plea not guilty and entrapment. theres no way in hell you should be doing time or get a mark on your record for this bullshit. and if they really wanted to track you down, they could look at the schools student roster and find which school you go to and wait for you... but i'm sorry its turned into a shitty situation for you

Sorry guys. there's no law that says the police must tell the truth. and the example here is definitly NOT entrapment.

you just have to be smarter than the cops, and in this case, you weren't. how many confessions do you think have been made because 2 people were involved, they were put in seperate rooms, and they were stupid enough to talk without a laywer? cops walk in and say "save yourself now kid, your buddy's over there ratting you out, you're gonna take all the blame unless you tell us your side of the story too"

again, there's no law that says they cannot lie to you.

Undercover agents, trying to bust a drug dealer, and the drug dealer asks "hey, you're not cops, are you?"

do you think they have to respond with "aw, gee shucks, you busted us! we're cops! sorry! have a nice day!"

all they have to do, when questioning you, is read you your miranda rights. anything after that is fair game.


Entrapment is when the police coerce you into doing something illegal that you were not otherwise going to do. so, let's say your state, it's allowed to pull you over in an unmarked cruiser (in ohio, it's not) it would be illegal for a cop to come up behind you, ride your ass, and trying to get you to speed, just so he can pull you over for speeding.

or, a more clear example, an undercover female officer walks up to you, and offers repeatedly, "wanna pay me for sex? come on, pay me for sex. you know yo uwant to pay me for sex" and when you finally say "ok" they arrest you for prostitution. THAT is entrapment. lying to you to get you down to the station peacefully? that is NOT entrapment.

in order for the undercover female officer to be legal, she has to stand out on the street, and wait for you to approach her, asking to hire her for sex. THEN they can arrest you, because YOU initiated the illegal activity.
 
anyway, hope your lawyer can help you out. I've been there, done that. as a freshmen in HS, I broke into the high school with a buddy of mine...we just watched a movie...I think it was sneakers? anyway, one of those "get in and out without anyone knowing you were there...mission impossible" type situations, and we wanted to do the same thing.

we were successful. we got in, walked around, the alarm system never went off, and we got out. cops never showed up. the school didn't know it even happened. we defeated the magnet sensors and the motion detectors with some carful planning and pre-positioning.

anyway...we were bragging about it, and someone turned us in. the school had the janitor look into it, and verified that we probably did do it.

cops were called, and they tricked us into confessing (the old "tell us now, and it'll be better for you in the end" trick, --we were 14!!! scared shitless because a cop was questioning us...definitly more serious than just the principal! yea, too bad I didn't know then what I know now...we were minors, no parents there, no miranda rights warning, etc.) anyway, they charged us with 5 offenses,to include 2 felonies! total time behind bars would have been like 5 years! there were kids in "Juvey detention" with much less severe charges, but were in general, much worse people!

so yea, I know what it's like when the law takes something and blows it out of proportion. --they do that knowing that the defense will be willing to plea bargin down to lesser offenses, and sadly, the whole exchange is kind of like buying a car or a house. the prosecution is going to throw the book at you. if they want to get you for simple tresspassing, then they'll charge you with tresspassing, vadalism, disturbing the peace, and anything else they can think of. then offer up "hey, plea guilty to tresspassing, and we'll let the others go"

talk to your lawyer about your defense. you want to enter in anything good about you--grades, sports teams you play on, boy scouts, etc. things that show good character. then show that you've never been in trouble before, that you're a good kid, and this was a 1 time mistake, where you were just trying to help a buddy get un-stuck, and didn't mean to do anything wrong. the fact that your a minor still in high school should help, ask for forgivness from the judge, ask him to dismiss the charges so that you don't have them on your record, yo ucould even give some BS about being interested in a career in the military or law enforcement and having a criminal record could hurt your chances.

Remember, even if you respect your local LEOs and you want to be cooperative for them, with them, etc. the very second you hear them state: you have the right to remain silent, you have the right to an attorney.." they have stopped being on your side, and they are now treating you like a suspect.

you need to go into "self preservation" mode. ANYTHING you say, could be used against you, so your best bet is to say nothing except "I would like a lawyer present during questioning, thank you"

even if you are innocent.

here's another story...happened to me.

soph. year of college. I hook up with a girl. one night stand. she wanted more, and I said "sorry, I got what I wanted" and she didn't like that.

anyway, 3 years later, right before graduation, she decided to claim that I raped her. in my mind, it wasn't rape, she never said no, she never did anything to stop me.

when they read me my rights, I didn't say a peep. nothing. asked for a lawyer, even though I knew in my heart, that I was innocent.

because 3 years had gone by, the only evidence they had, was her testimony. there was never a rape kit done, nothing, so there was no phsyical evidence. so now in order to prove rape, they must prove that we had sex, and that she didn't want it to happen.

if I tried to be cooperative, and answer their questions, my side of the story would have come out as "yes, we had sex, but she didn't say no" well, I just confessed to half the crime. they no longer have to prove that sex happened, because I admitted it did. now all they have to do is prove that she didn't want it to happen, which is as simple as putting her on the stand to say "I didn't want it to happen and said no...but he didn't listen"

instead, because I said nothing, they had no evidence of anything, the charges were dropped due to lack of evidence, and it never went to trial.

So, remember, when you are read your rights, EVEN IF YOU ARE INNOCENT, your best bet is to say nothing...even if it means they detain you for a few hours at county lock up.

a few hours in lock up is much better than a criminal conviction and time in lock up
