Hey all,

Just wanted to see how this sounds to you guys...

So I'm stopped at a light, in the right turn lane. Car in front of me starts to go (light is red, but no cars coming and right on red is allowed), so I start moving up. All of the sudden, car in front of me slams on brakes for no apparent reason, and I slam on mine, coming very close but didn't hit her. She goes around the corner and pulls over, I see that she pulled over, so I do as well just to be sure nothing happened. I get out of my truck, she jumps out of hers freaking out, yelling and the whole 9 yards. I said "I didn't hit you", and walk to the rear of her vehicle, and observe that there is no damage. No scratches, no blemishes, no paint, no nothing. FLAWLESS rear bumper. Only noticeable thing was that the little plastic hitch cover (one of these things: http://www.autoaccessoriesgarage.com/img/group/main/43/4378_1_lg.jpg) looked as if someone improperly re-latched it. Part of it was hanging down, and a simple push at the bottom of the cover would've fixed it.

However, lady calls cops, they come and give me a ticket because I had previous damage on my truck. From the cop's standpoint, I guess I would've given me a ticket too, but looking at the back of her car, I am confused as to why I got ticketed. The bumper on my truck was and has been cracked, and one of the fog lights was cracked from something else. I have plenty of people who know my truck was previously damaged, in addition to the fact that I already drilled holes at the end of the cracks a long time ago. There's no way any of my damage was from this anyways, because there was no contact what so ever.

To me, it sounds like someone is trying to milk the insurance company, and they thought that they found someone they could get away with it with. I'm really pissed off by this whole thing, because there's no reason this should've happened in the first place, and the woman was a total b!tch. And at this point, it's basically my word (I'm a 17 year old kid) versus her word (40 some odd year old scary looking woman). However, my mom was with me, and she didn't feel any impact either. I've got like 20 pictures of other woman's car to prove no damage was done, and like I said I've got lots of witnesses to the damage that was already on my truck.

On a side note, this woman is really just screwing herself over... She's filing an accident report with the state, so it's going to go on the carfax for that vehicle... It's a 2011 too. So, when she goes to trade it in the dealer or whoever will look at the carfax and give quite a bit less due to the "accident" that occured. I guess that's going to be her karma, or at least I hope it is.

The main thing I'm worried about is what my insurance company is going to do after this. Hopefully they'll see nothing happened and that my damage was there before, but if they don't my rates could jump, or worse yet they could drop me. All because the woman claims that I hit her, which I didn't. I guarantee I didn't even tap her bumper, because like I said, there was absolutely NO marks on her bumper, and NOTHING (other than previous damage) on mine.

My question is what do you guys think of this, have any of you had something similar happen? This really seems to be like they're trying to pull some kind of insurance scam on me.

Failure to reduce speed to avoid an accident (which never even occurred).

yep take that shit to court. fuck her and the police *high fives big texxan* i bet that bitch was a richy snob that has nothing better to do with her life then fuck other's up. if you rates go up or they drop you that would be soooooooooooooooooo fucked up.

Yeah, now I understand why people say that lol. I fully intend on fighting this.

And troy, yeah, she definitely seemed like the rich snob type. Just hope the insurance company doesn't fall for it
 
Dude, everytime I get stopped by the police, I always challenge them in the rights and shit, then take it to court. Ive only met one good cop in my life, and I dont think that number will get any higher
 
I shoot first, shoot some more, shoot once more than ask questions later. If your a good cop than excuse this, but everytime Ive needed them, theyve never been there. Such bullshit, and when I dont want them, they are all over me

That's why you always make sure you have ample room between you and the car ahead.
We were stopped with plenty of space. She started to go, I followed. She slammed her brakes, I slam mine, but I guess she stopped faster than me, because I very narrowly avoided hitting her. I'm not ragging on the cops, but there are some good and some bad. Clearly, no damage was done to her car. I basically got a ticket because the front of my truck was previously jacked up, and I can't afford to fix it right now.

I'd definitely fight it. Get some witnesses that can testify that the damage is old damage. Sounds like a pretty raw deal to me.

Any third party witnesses at the scene that can collaborate whether there was contact? That would be your best bet, find an unrelated witness that can say there was no contact.

At this point it's pretty much your word against hers whether you actually hit her or not.

Or hit up any stores near by and see if they had security cams that you could use..
 
lol iv met one nice cop and one half nice half dick cop before....nice one is the one for our high school keepin the preggo hoodlums calm. and the half and half is when i got pulled over for doing 12 over yet my friend in front of me was going 15 prob more... BUT i got a warning so that was pretty nice i guess.............. okay back on topic now, when my brother wasnt paying attention (claimed the brake pedal thing "fell off") and ran into the guy in front of him, my brothers truck WAS FUUUUUUUUUUCKED up. the other guy had a trailer hitch hooked up and saved him from nothing more then a inch long scratch, guy was like eh, i aint callin the cops, i aint reporting it. Because it was my bros fault. so people are nice... NOT THAT BITCH!!! haha after she got all mad when everyone was leaving she might go a little ways then have a flat tire :D
 
All that damage on the front of your truck and no damage to hers and he gave you a ticket? There should have been scuff marks or something on her bumper from your truck if there was that much damage done. Did you or your mom ask the cop why? How did he come to the conclusion there was actually an accident when there was no damage done to her car, this doesn't sound right. Get you insurance company involved, this is what you pay them for, make sure you give them or show them the pictures of both cars. Did the cop ask her if she was alright? I see whiplash coming on for her, pain and suffering, good for a couple o bucks. Just because she looks snobby and is old doesn't me she isn't a scammer
 
Why the fuck did you stop in the first place? You know you didn't hit so why even bother? Even if you did hit and drove off, not much luck finding you, let alone no hit. Sorry, but you fucked yourself by stopping! You really was a perfect target!

Really?!? Your advice is you should have left the scene?

Someone gets his plate, the cops go to his house, see the damage and he's toast, but not just for a citation but also a criminal violation now.

The scene of what, a close miss?
He claims he didn't hit her, damage or not. His mother was in the car, 1 witness for him, 0 for her.
